• Entities. If you use the Services on behalf of an organization, you represent you’re authorized to bind that organization, and “you” includes both you and the organization.

• Geographic Use. We operate from the United States (Georgia). You’re responsible for compliance with local laws if you access the Site from outside the U.S.

 

2) Acceptable Use

 

You agree you will not:

 

• Use the Site for unlawful, fraudulent, harassing, harmful, or defamatory activity.

• Attempt to interfere with, disable, or disrupt the Site (e.g., hacking, scraping, introducing malware).

• Copy, reproduce, resell, or commercially exploit any portion of the Site or its content without our written permission.
   We may monitor use and suspend or terminate access for violations.

4) User Content; Testimonials; Likeness

 

• User Content. If you submit reviews, comments, stories, testimonials, images, or other content (“User Content”), you represent you own it or have rights to submit it and that it doesn’t violate any laws or third-party rights.

• License to Us. You grant us a worldwide, royalty-free, sublicensable license to use, reproduce, publish, display, edit, and distribute your User Content in any media for operating, improving, and promoting the Services (including marketing).

• Event Recordings. By attending our in-person or virtual events, you acknowledge events may be photographed/recorded and consent to our use of your likeness, voice, and participation for promotional purposes without additional consideration, unless prohibited by law.

 

5) Purchases; E-Commerce

 

• Orders. We may offer books, workbooks, merchandise, tickets, digital downloads, or other products/services. We reserve the right to decline or cancel orders (e.g., suspected fraud or pricing errors).

• Pricing & Taxes. Prices are in U.S. dollars and may change without notice. Applicable taxes, shipping, and handling are additional.

• Payment Processing. We use third-party processors (e.g., Stripe/PayPal). Your payment information is collected and processed by those providers under their terms and privacy policies.

 

6) Shipping, Returns, Refunds (Summary)

 

• Physical Goods. Shipping methods, timing, and fees are shown at checkout. Risk of loss passes to you upon our delivery to the carrier.

• Digital Products. Unless otherwise stated, all sales of digital products (downloads, recorded trainings) are final.
   Where a separate written agreement applies (e.g., corporate contract), that agreement controls.

 

7) Bookings: Speaking, Workshops, Coaching

 

• Inquiries & Proposals. Availability, scope, and fees are confirmed in writing.

• Deposits. To hold dates, a non-refundable deposit (e.g., 50%) may be required; balance typically due [14] days before the event, unless your contract states otherwise.

• Travel & Production. Client typically covers reasonable travel, lodging, and production costs if applicable.

• Rescheduling/Cancellations. If you reschedule or cancel, fees may be non-refundable, and change fees may apply. See your specific agreement for exact terms.

• Coaching. Coaching sessions must be used within the stated program window. Missed sessions without timely notice may be forfeited.

 

8) No Professional Advice; Results Disclaimers

 

• Not Therapy, Medical, Legal, or Financial Advice. Content and coaching are educational and inspirational and reflect Kat’s experience and perspectives, including faith-based elements. They are not a substitute for licensed counseling, medical care, legal, tax, or financial advice. Seek qualified professionals for those areas.

• No Guarantees. We do not guarantee outcomes (e.g., income, promotions, health changes, team performance). Your results depend on many factors outside our control.

 

9) Third-Party Links & Tools

 

The Site may contain links to third-party sites or tools. We do not control or endorse them and are not responsible for their content, policies, or practices. Your use is at your own risk.

 

10) Disclaimers

 

The Site and Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. 11) Limitation of Liability

 

To the fullest extent permitted by law, I Am Kat Perkins, LLC and its owners, officers, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Site or Services.

If we are found liable despite the above, our total liability to you for all claims in the aggregate will not exceed the greater of (a) USD $100 or (b) the amount you paid to us for the Service that gave rise to the claim in the six (6) months preceding the event.

 

12) Indemnification

 

You agree to indemnify and hold harmless I Am Kat Perkins, LLC and its representatives from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your (a) use or misuse of the Site or Services; (b) violation of these Terms; or (c) violation of any rights of a third party.

 

13) Copyright & Trademark Complaints (DMCA)

 

If you believe content on the Site infringes your copyright or trademark, please send a notice including: (i) identification of the work or mark; (ii) the allegedly infringing material and its location; (iii) your contact information; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury that you’re authorized to act; and (vi) your signature.

14) Governing Law; Disputes

 

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in Newton, Georgia for any dispute not subject to arbitration.

 Informal Resolution. Contact us first to attempt good-faith resolution within 30 days.

Arbitration:If included by reference in your service agreement, disputes will be resolved by confidential, binding arbitration in Covington, Georgia, under the rules of the American Arbitration Association by a single arbitrator. No class actions. Each party bears its own fees.

We may seek injunctive relief for IP or confidentiality breaches in any court of competent jurisdiction.

 

15) Changes to the Terms

 

We may update these Terms from time to time. The “Last Updated” date will reflect changes. Your continued use of the Site after changes constitutes acceptance.
